STANDARD TERMS AND CONDITIONS OF BUSINESS
These are the standard terms and conditions of business between Work Permit Consultants and you the client.
FEES
Our initial advice to you is free
We offer a competitive fixed fee with a no win no fee guarantee. All fees are payable in advance. If after evaluating your case (upon receipt of all documentation) we feel there is a reason that the Home Office may not grant work permit approval, we will discuss this with you at the time and may not offer this guarantee. It is your choice at this point to decide whether or not to proceed with us and if you decide not to proceed at this stage, your payment will be refunded in full. If we have given our guarantee, a refund will be that part of the payment covering our fees plus VAT but excluding the Home Office Fee and any advertising costs or disbursements. Consequential loss is NOT covered
All fees are detailed on the list of documents we require from you and which will have been sent to you following your initial consultation. Fees may change from time to time. If your initial enquiry is followed up with a request for us to act for you within 3 months of that initial request, our fees listed to you at that time will remain at that quoted price, the exception being that of any increase in Home Office Fees or government legislation.
Disbursements, such as courier costs incurred by us in sending documents to the home country of the candidate, will be charged extra by invoice following the successful receipt of a work permit and are payable within 14 days of the invoice.
Engagement
By instructing us to make representation on your behalf, you accept and abide by these terms and agree to follow our recommendations and advice. Should you ask us to pursue a course of action that we do not endorse, our fee will be levied irrespective of the outcome of any application made on your behalf.
Your Obligations to us
You are obliged to forward each and every document on the published list of documents which has been forwarded to you and which may change from time to time. Failure to supply any of the requested documents will nullify our guarantee. The Home Office reserve the right to request additional information at any time and we will pass on these requests to you. Failure to comply will also nullify our guarantee.
By forwarding these documents to us, you guarantee that these documents are genuine and that no fault can be attributed to Work Permit Consultants should these documents later prove to be false or forged in any way
You guarantee that all material facts which may affect the outcome of the application, be disclosed to us.
You accept that if the instruction in respect of any application is withdrawn by you once we have submitted it to the Home Office for approval, no fees shall be refunded.
You further accept that should you withdraw your instruction before the application has been submitted to the Home Office, fees will still remain due to us. The exact figure shall be determined by us and we guarantee they will be no more than 75% of the total fee such sums that are due to be refunded to you will be made by cheque to the original payer.
Our obligations to you
We will submit your application in a timely manner
We guarantee to maintain client confidentiality at all times. Your company documents will not be retained by us and will only be shown to the Home Office and sent to them by recorded or special delivery
We will at all times endeavour to offer you the most up to date advice in line with the Home Office and Immigration guidelines. Each and every case will be given our fullest and best attention.
We will advise you either by telephone or email of any progress reports, further requests for information from the Home Office and supply you with copies of any letters from the Home Office should you request these.
Liability
Work Permit Consultants accept no liability for any loss suffered by you or any third party with whom you are connected, consequential or otherwise, occasioned by any delay to or rejection of any application made on your behalf, other than the agreed fee guarantee if this has been given.
Complaints
Any complaints relating to the service provided by Work Permit Consultants shall be made initially to our current Office Manager. You also have a right to complain to the Office of the Immigration Services Commissioner at 5th Floor, 53 Tooley Street, London SE1 2QN.
Law
This Agreement shall be construed in all respects in accordance with English Law and the parties agree to submit to the jurisdiction of the English Courts
